1. Acceptance of Terms

By accessing or using the Site, you affirm that you have read, understood, and agreed to be legally bound by these Terms of Use (hereafter “Terms”). If you do not accept the Terms, discontinue use immediately.

“Service” encompasses all pages, products, software, APIs, emails, push notifications, calculators, data, text, images, graphics, charts, audio, video, design, features, and other materials or functionality made available through the Site.

3. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction (whichever is greater) to use the Service. By accessing the Service, you represent that you meet this requirement.

4. Permitted Use

You may use the Service exclusively for personal, non-commercial financial education; running calculations for your own planning; and sharing unmodified public-facing pages by direct URL links.

5. Prohibited Conduct

• Engage in unlawful, fraudulent, or deceptive activity.
• Reverse-engineer, decompile, or otherwise attempt to extract source code from any proprietary calculator or script.
• Copy, reproduce, distribute, or create derivative works without written permission.

7. Service Modifications

KaChing Labs reserves the right to modify, suspend, or discontinue any part of the Service at any time without liability or notice.

8. Termination

KaChing Labs may terminate or suspend your access to the Service immediately and without notice if it believes you have violated these Terms. Upon termination, your right to use the Service will cease.

9. Indemnification

You agree to indemnify and hold KaChing Labs harmless from any claim or demand (including reasonable attorney’s fees) arising out of your use of the Service, your violation of the Terms, or your violation of any rights of another.

12. Governing Law & Venue

The Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law rules. All legal actions shall be brought exclusively in the state or federal courts located in King County, Washington.

13. Dispute Resolution & Arbitration (Optional)

At KaChing Labs’s sole discretion, any dispute may first be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and judgment on the award rendered may be entered in any court having jurisdiction.

14. Severability

If any provision of the Terms is found unenforceable, that provision will be modified to reflect the parties’ intention, and all remaining provisions will remain in full force and effect.

15. No Waiver

KaChing Labs’s failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms constitute the entire agreement between you and KaChing Labs regarding the Service and supersede all prior and contemporaneous agreements, proposals, or communications.

KaChing Labs may amend these Terms from time to time. An updated “Last Updated” date will appear at the top. Continued use after changes indicates acceptance of the new Terms.

We employ industry-standard safeguards, including TLS 1.3 encryption for data in transit, firewall-protected servers hosted in SOC 2-certified data centers, and role-based access controls.

We share data only with trusted providers who are bound by contractual privacy obligations, such as: Google Analytics (analytics), and Cloudflare (content-delivery and DDoS protection).

The Service is not intended for children under 13. We do not knowingly collect personal data from minors. If we learn we have collected such data, we will delete it immediately.
